Terms of Use

1. About these Terms
These Terms of Use govern your use of TurnoutFlow, the app and the website at app.turnoutflow.com, as a member, officer, staff member, or applicant of a fire or EMS department that uses TurnoutFlow (your "department"). Your department uses TurnoutFlow under its own Subscriber Agreement with us, which covers its subscription, fees, and the service we provide to it. These Terms cover only your individual use. If you do not agree to them, do not use TurnoutFlow.
2. Access through your department
Your access comes through a department. The department decides who has an account, what each person can see and do, and which parts of TurnoutFlow it uses, and it can change or end your access. If the department stops using TurnoutFlow, your access to that department ends.
3. Your account
Keep your sign-in details to yourself, and tell your department or us if you think someone else has used your account. You are responsible for what is done under your account. Give accurate information, especially in an application to a department. You can delete your account at any time from your profile, on the web or in the app; our Privacy Policy explains what is deleted and what your department keeps.
4. Your department's records
Information you enter, and the records your department keeps about you, such as your roster entry, call responses, incident reports, training and LOSAP records, and any application, belong to the department. The department keeps them under its own policies and the public-records and retention laws that apply to it. We handle them on the department's behalf, as our Privacy Policy describes, and we do not sell them. Questions about those records, or requests to correct them, go to your department.
5. Acceptable use
Do not: try to get around security, or reach another department's data or another person's account; share information from TurnoutFlow beyond what your department allows; upload malicious code; submit false or misleading information; scrape or bulk-copy data outside the export features provided; send spam or unlawful messages; or use TurnoutFlow in a way that breaks the law, including employment, volunteer-screening, and anti-discrimination law.
6. Suspension
We may suspend or close an account that breaks these Terms or puts the security of TurnoutFlow, a department, or other people at risk. Where it is practical, we will tell your department first.
7. Ownership
TurnoutFlow and its licensors own the app, the website, and the software behind them. You may use them only through your department's access and under these Terms. If you send us suggestions, we may use them without any obligation to you.
8. Disclaimers
TURNOUTFLOW IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that TurnoutFlow will be uninterrupted or error-free, and nothing in it is legal, medical, or employment advice.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNOUTFLOW WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, ARISING FROM YOUR USE OF TURNOUTFLOW. Our responsibilities to your department are set out in its Subscriber Agreement.
10. App stores
If you use the TurnoutFlow app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for the app or its support; questions go to us.
11. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will tell you in the app or by email before it takes effect. Using TurnoutFlow after that date means you accept the updated Terms.
